DMCA Policy

At "Salted Peanut Butter Truffles And A Rant", we respect the intellectual property rights of others and expect our users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines our procedures for addressing copyright infringement claims and for issuing counter-notifications.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the DMCA and to take appropriate action, which may include removing or disabling access to allegedly infringing material and, in appropriate circumstances, terminating accounts of repeat infringers.

Filing a DMCA Notice (Takedown Request)

Please be aware that you may be liable for damages (including costs and attorneys' fees) if you materially misrepresent that material or activity is infringing your copyrights.

  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

Filing a DMCA Counter-Notification

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with us. To be effective, your counter-notification must be a written communication provided to our Designated Copyright Agent and must include substantially the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located, or if your address is outside of the United States, for any judicial district in which "Salted Peanut Butter Truffles And A Rant" may be found, and that you will accept service of process from the person who provided the original notification of alleged infringement.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notice. If the complaining party does not file an action seeking a court order against you within 10-14 business days, we may, at our sole discretion, restore the removed material.
